OSHA Cites Ohio Employer for Death of Worker in Horrific “Crushing” Accident, Rights of Injured Workers Under Mississippi Workers’ Compensation Laws Explained

An Ohio auto component manufacturing company is in hot water after the Occupational Safety and Health Administration (OSHA) levied fines against it in its investigation into the employer after a worker was killed on the job last year. According to local Ohio news reports, Cinncinatti.com, the United States Department of Labor determined this week that auto component manufacturing company Faurecia Emissions Control Systems NA LLC, could have prevented the death of a worker who was killed in October, 2023. Faurecia Emissions Control Systems NA LLC, is a subsidiary of one of the top automotive suppliers in the world.

OSHA investigators report that the worker who was killed on the job at Faurecia Emissions Control Systems in October, 2023, was in the process of placing cardboard under a machine at the manufacturer that bends vehicle exhaust pipes. As the worker was placing the cardboard under the machine, the worker was crushed, and was killed. OSHA investigators believe that the horrific workplace accident could have been prevented by Faurecia Emissions Control Systems “if the company had provided proper machine guarding.” Of the terrible and fatal workplace accident, OSHA officials stated, “Faurecia Emissions Control Systems could have prevented this tragedy by having proper machine guarding that would have prevented employees from contact with moving machine parts…Safety requirements are just that, required. This company failed in its legal responsibility to ensure workers were protected from workplace hazards.”

In response to the 10 safety citations OSHA assessed against Faurecia Emissions Control Systems, OSHA levied fines against the company in the amount of $314,555. The safety citations include the company’s failure to train employees, failure to adequately provide and maintain machine guards, failure to include detailed steps for machine lockout and tagout processes, and failure to test safety procedures on a yearly basis. OSHA concluded that Faurecia Emissions Control Systems “exposed machine operators to struck-by and caught-between hazards.”

The worker who was killed in the terrible workplace crushing accident at Faurecia Emissions Control Systems was only 26 years old. In 2022, OSHA cited Faurecia Emissions Control Systems for similar safety violations.
