Valdivia argued that the company that employed him, Brock Services, “ignored basic safety protocols and failed to report the injury to OSHA, possibly to avoid liability.” In addition, “An occupational physician contracted by Brock initially classified the injury as minor, but later retracted that assessment after reviewing previously withheld documents during trial proceedings.” The Baton Rouge jury that heard the details of the horrific workplace accident case ultimately found in favor of Valdivia.
