Instead, eligibility depends on several factors, including the size of the employer, the type of work being performed, and the worker’s legal classification.

According to the Mississippi Workers’ Compensation Commission, “Most working Mississippians are protected by the Workers’ Compensation Law, but there are exceptions.” The law requires that “all employers with five (5) employees regularly employed are required to provide workers’ compensation insurance coverage.” This means that if an employer meets this threshold, injured employees are generally entitled to workers’ compensation benefits for job-related injuries or illnesses.

When an employer has fewer than five employees, coverage is not mandatory. However, the Commission explains that “if the employer has less than five (5) employees, workers’ compensation coverage is not mandatory but may be provided voluntarily by the employer.” In these situations, eligibility depends on whether the employer has chosen to carry workers’ compensation insurance.

Who Is Not Automatically Covered Under Mississippi Workers’ Comp

While coverage is broad, Mississippi workers’ compensation laws specifically exclude certain categories of workers unless coverage is voluntarily provided. The Mississippi Workers’ Compensation Commission states that “domestic and farm labor, and employees of non-profit fraternal, charitable, religious or cultural organizations are not covered under the Law unless coverage is provided voluntarily by the employer.”

In addition, “the Workers’ Compensation Law likewise does not apply to federal employees or certain transportation and maritime employments covered by federal compensation laws.” These workers may be covered under separate federal systems rather than Mississippi workers’ compensation.

Independent Contractors and Subcontractor Workers in Mississippi and Workers’ Comp Coverage

Independent contractors are another group that often faces confusion about eligibility. As the Commission explains, “independent contractors are ordinarily excluded from coverage.” However, Mississippi workers’ compensation law provides that “special protection is given to employees of subcontractors.” This means that in some cases, workers who believe they are independent contractors may still qualify for benefits depending on how their work relationship is structured and who controls the job. Importantly, because misclassification is common, determining eligibility often requires careful legal analysis of job duties, payment structure, and the employer’s level of control.
