Were You Injured in a Serious Workplace Accident in Mississippi and You Want to See Your Own Doctor? Find Out Your Rights to Select Your Physician Here

When a worker is injured on the job in Mississippi, one of the first things that they may think about and wonder is whether they can be treated by their primary care provider or their family doctor. Indeed, when a serious workplace injury happens to a Mississippi worker, the last thing they likely want to do is to see a new doctor who they do not know and do not trust to treat their injury and help them get back onto their feet and back to work. But can an injured Mississippi worker be treated by their own physician or their family doctor that they select, or will the Mississippi Workers’ Compensation Commission (or their employer’s insurance company) pick one for them? To help workers who have been recently injured in Mississippi better understand their rights to their own doctor of their choosing, we answer that question here.

Selecting a Doctor or Physician in Your Mississippi Workers’ Compensation Case

According to the Mississippi Workers’ Compensation Commission, the state agency that handles injured Mississippi workers’ workers’ compensation claims, “The Workers’ Compensation Law provides that an injured worker has the right to select one physician or medical provider of his or her own choosing to render treatment. This chosen provider may make one referral of the worker to another specialist to continue treatment without any approval from the employer or its insurance carrier. However, any additional selections or referrals must be approved in advance by the employer or its insurance carrier. The worker is not limited to a licensed medical doctor and may choose, for example, a chiropractor for treatment. The worker is also entitled to mileage reimbursement for trips to the doctor.” However, it is important to keep in mind that while under Mississippi workers’ compensation laws, an injured worker typically has the right to choose their own doctor, if the injured worker’s workers’ compensation claim is disputed, they may be required to undergo an Independent Medical Examination (IME). The IME doctor is typically not chosen by the injured worker, but rather by the employer’s insurance company.
