Pontotoc Personal Injury Lawyer

Lunsford, Baskin & Priebe PLLC represents injured people in Pontotoc County and throughout Mississippi and Louisiana, with workers’ compensation at the center of our practice and personal injury, car and truck accident, premises liability, and wrongful death claims alongside it. A Pontotoc personal injury lawyer who also lives in the workers’ comp system sees something many injury lawyers miss: a crash on Highway 15 or a fall at a job site often creates two claims at once, and each one affects the other.

Pontotoc sits in the middle of a working corner of north Mississippi. Furniture and upholstery plants, poultry operations, trucking, and the commuter traffic running between Pontotoc, Tupelo, and Oxford put a lot of people on the road and on production floors every day. When someone is hurt in that setting, the first question is usually not “who is at fault?” but “was I working when it happened?” The answer decides which rules apply, how much time you have, and who pays.

Why Choose Lunsford, Baskin & Priebe for a Pontotoc Injury Claim

Lunsford, Baskin & Priebe PLLC is a Mississippi and Louisiana firm that represents injured workers and accident victims, including clients in Pontotoc, Tupelo, Oxford, and communities across north Mississippi. We have recovered more than $100 million in settlements for our clients. Most lawyers who take comp cases are personal injury lawyers who handle a work injury only when one walks in. We built the firm the other way around, which matters when your injury claim and your comp claim have to be coordinated.

Rob Lunsford, our Founding Partner, has spent his entire legal career representing injured workers. Brad Baskin and Jennifer Priebe, both Partners, have been recognized by Best Lawyers, Super Lawyers, and The National Trial Lawyers, and the firm was ranked by Best Law Firms for Workers’ Compensation Law, Claimants, in Jackson. Andrew Rueff has successfully tried dozens of jury and bench trials to verdict and has argued personal injury and insurance matters before Mississippi’s appellate courts.

Results give a sense of the work. We also recovered $221,000 for a land-based oil rig worker with severe burns. Clients tell us they appreciated being listened to and having an attorney who stood up to the insurance company at every step. Consultations are free, we advance the costs of the case, and you owe no fee unless we recover for you. Our phones are answered 24 hours a day, and we speak Spanish: hablamos español.

Common Injury Claims We Handle for Pontotoc County Residents

  • Work Vehicle and Commuter Crashes: Pontotoc workers drive to plants, job sites, and delivery routes across several counties. If a negligent driver hits you while you are on the job, you may have both a comp claim against your employer’s carrier and a separate injury claim against the driver.
  • Truck Accidents: Freight and poultry trucks move heavily through north Mississippi. Collisions with commercial trucks tend to involve serious injuries, multiple insurers, and trucking companies that investigate quickly.
  • Premises Liability: Falls from unsafe stairs, poor lighting, wet floors, or defective equipment on someone else’s property can support a claim against the owner or a contractor. At a work site, a third-party contractor’s unsafe conditions can open a claim beyond comp.
  • Back, Neck, and Spine Injuries: Disc herniations are among the most common injuries we see in both crashes and physical jobs. Insurers often blame degenerative disc disease, so the medical evidence has to show how the incident caused or worsened the condition.
  • Shoulder and Knee Injuries: Rotator cuff tears, SLAP tears, ACL tears, and meniscus tears often follow repetitive lifting, falls, or impact. Employers and insurers sometimes call them old sports injuries.
  • Fractures and Burns: Broken ankles, feet, and hips can require specialists and surgery, and burns from industrial settings can be catastrophic. These cases carry long recoveries and high medical costs.
  • Wrongful Death: When a fatal crash or workplace accident takes a family member, survivors may have claims that depend on how the death occurred and who was responsible.

What to Do After an Injury in Pontotoc County

Start with medical care, even if the injury seems manageable. Tell the provider exactly how it happened and which body parts hurt, because early records are what insurers compare against later. Take photographs of the scene, your injuries, and any equipment involved, and write down the names of witnesses while memories are fresh. If a crash is involved, make sure a police or highway patrol report is filed.

If you were hurt at work, report it to your employer promptly. In Mississippi you must give notice within 30 days of the accident, and you generally have two years to file a petition with the Mississippi Workers’ Compensation Commission. Coverage applies from your first day on the job. Do not wait to see whether the pain goes away; late notice is one of the easiest ways for an insurer to challenge a claim. Mississippi comp claims are decided by the Commission, not a court, through an evidentiary hearing before an Administrative Judge, with review by the Full Commission available afterward.

For a claim against a negligent driver or property owner, most Mississippi injury lawsuits must be filed within three years under the general limitations statute, though latent injuries can follow a discovery rule. Claims against a county or other governmental body are different: they carry a one-year limit and require advance notice under the Mississippi Tort Claims Act. If a government vehicle or public property is involved, that deadline can arrive much sooner than people expect.

Be careful with insurance adjusters. Recorded statements, quick settlement offers, and broad medical releases can all be used against you. Keep your own list of missed work, medical visits, and out-of-pocket costs. If you are unsure which system your injury belongs in, a call to us costs nothing, and we can sort out whether you have a comp claim, an injury claim, or both before anything is signed.

How Comp and Injury Claims Fit Together

The workers’ compensation system pays medical treatment and wage replacement regardless of fault. Wage benefits for total disability run at two-thirds of your average weekly wage, up to a statutory weekly maximum and for no longer than 450 weeks. The tradeoff is that comp generally does not pay for pain and suffering and generally prevents suing your own employer for negligence.

A third party changes that. If a driver, equipment manufacturer, or outside contractor caused your injury, you can pursue that party for the full range of damages while still collecting comp. The two claims must be managed together, because the comp carrier may have a right to be repaid from a third-party recovery, and settling one claim carelessly can damage the other. That coordination is why we handle both under one roof.

Fault matters in the injury half. Mississippi follows pure comparative negligence, so if you were partly to blame, your recovery is reduced by your percentage of fault rather than eliminated. Insurers often try to inflate that percentage, which is one more reason to gather evidence early.

Questions Pontotoc Injury Victims Ask

Do I need a personal injury lawyer or a workers’ compensation lawyer?

It depends on how you were hurt. An injury on the job usually belongs in the comp system, while a crash or fall caused by someone else may support an injury claim. Many cases involve both, such as a delivery driver hit by another motorist. We handle both types.

How much does it cost to hire your firm?

Nothing up front. Consultations are free, we advance the case costs, and we are paid only if we recover benefits or a settlement. In workers’ compensation cases, attorney fees are limited and approved under state law.

How long do I have to report a work injury in Mississippi?

You must report it to your employer within 30 days of the accident. Reporting immediately is far safer, since delay gives the insurer an argument that the injury did not happen at work.

How long do I have to file a workers’ compensation claim?

Generally two years from the date of injury or from the last compensation payment, by filing a petition with the Mississippi Workers’ Compensation Commission. If no disability benefits have been paid within two years and no claim was filed, the right to benefits can be lost.

What is the deadline for a car accident lawsuit in Mississippi?

Most injury claims without a special limit must be filed within three years after the claim arises. Claims against a county or governmental agency are far shorter: one year, with notice required under the Mississippi Tort Claims Act.

What if I was partly at fault for the accident?

Mississippi uses pure comparative negligence. Your compensation is reduced by your share of fault but not barred. Even a significant share of blame does not necessarily end the claim.

Can I collect workers’ comp and sue the person who caused my injury?

Yes, when someone other than your employer caused the harm. You can receive comp benefits and pursue the third party for additional damages, though the comp carrier may seek reimbursement from that recovery, so the claims need to be coordinated.

Will my health insurance pay while my claim is pending?

Sometimes, but be careful. If the injury is work-related, the comp carrier is responsible for authorized treatment, and health insurers may refuse or later seek repayment. Tell us before you rely on one source over another.

What if my employer’s insurer says my injury was a pre-existing condition?

A pre-existing condition does not automatically end a claim. If your job or an accident caused, worsened, or accelerated it, benefits may still be owed. We answer this argument with medical opinions and work history.

Can I be fired for filing a comp claim?

Mississippi protects workers from retaliation for filing a claim. If you were let go or punished after reporting an injury, tell us during your consultation so we can review your options.

Which court would hear my case if I am hurt in Pontotoc County?

A workers’ comp claim goes to the Mississippi Workers’ Compensation Commission. A lawsuit against a negligent party would be filed in the appropriate Mississippi court, and federal court in Oxford covers Pontotoc County for cases that qualify for federal jurisdiction. We will advise on the right forum for your situation.

What if the person responsible was driving for a company?

Employers can be responsible for workers acting within their job duties, and trucking and delivery companies often carry larger insurance policies. We look at both the driver and the company when evidence supports it.
